Conveyancing costs for Buying and Selling property are the fees and costs incurred through out the sale and purchase conveyancing process.

A property sale and purchase is a legal conveyancing transaction which involves the legal transfer of ownership from one party to another, for both the sale and purchase property, to occur simultaneously (in most cases).

Conveyancing costs for buying and selling a property will in most cases be made up of conveyancing solicitors or conveyancers legal fees for acting on behalf of the seller/buyer and any current mortgage lender together with any new mortgage lender plus legal disbursements (third party payments).

Conveyancing Costs for Selling and Buying Property - What will I be charged for?

  • Solicitors/Conveyancers Legal Fees - Your conveyancers or conveyancing solicitors labour costs for acting on your behalf and (where applicable) your outgoing and new mortgage provider.   Conveyancing Legal Fees will attract vat.
  • Legal Disbursements - Legal Fees charged by third parties (mainly to various administrative government departments) for services or information needed by your conveyancing solicitors through out the course of the conveyancing for your sale and purchase.

Property Sale - Legal Disbursements

You should note the following items may be charged as legal disbursements in the course conveyancing when selling your property:

HMLR - Land Registry Disbursements

  • Office Copies - With registered property an Official Copy Entry together with filed plan may be needed. The cost is usually less than £10.00.
  • Office Copy Deeds - Where deeds or documents are included within title to the property - costs vary between £5.00 - £20.00.

Disbursements for Other Documents

During the conveyancing process for some property sales the buyer’s conveyancing solicitors or conveyancers may request documentary evidence to prove title that need to be obtained from other organisations such as the Local Council.  Costs vary. 

Other Types of Disbursements

Some properties have title issues that the buyer’s conveyancing solicitors may not accept or consider unacceptable for a mortgage lender funding the purchase side.  Where this happens, it is necessary for both the buyers and sellers conveyancers or conveyancing solicitors to agree legally acceptable solutions to allow the sale of the property to move forward.    It is common for legal indemnity policies (insurance policies) to be used.  Costs will vary on the kind of legal indemnity policy required (the insured risk), the property value and the work involved in the negotiations and arrangements.

The legal disbursements for the purchase side of the conveyancing transaction will usually be:

Land Registration Fee

The Land Registry is the government department that deals with the ownership of land in England and Wales. Purchases will attract a Land Registry fee based on the purchase price as part of the total conveyancing costs. The Land Registry Fee payable is calculated on a fee scale dependent on the purchase price of the property you are buying.

Stamp Duty Land Tax

Stamp Duty Land Tax is attracted on property purchases over the current price threshold set at £125,000.  This figure is subject to revision by the government at any time.

Conveyancing Searches

There are numerous types of Conveyancing searches, the most common are:

  • Local Authority Search
  • Drainage and Water Search
  • Environmental Search
  • Chancel Check
  • Coal Authority Search

We, as specialist conveyancing solicitors, use a Law Society recommended NLIS provider (an online provider of official searches for speed, efficiency and quality purposes) to carry out our conveyancing searches and a fee will also be payable to the NLIS provider for use of the hub. The exact cost for conveyancing searches will usually be confirmed during the course of the conveyancing transaction.

Land Registry Searches

Final administrative searches include a Land Registry Search acting to freeze the register pending official registration of the purchase.  Costs under £10.00.

Where a mortgage is obtained to fund the purchase a bankruptcy or land charges search is required for each buyer.  Costs under £10.00.

Other Legal Disbursements

Most conveyancing purchase transaction will not need further disbursements and buying a property may not always involve all of the above disbursements.  In some cases conveyancing costs may be affected by disbursements other than previously mentioned.   Examples include the cost of arranging a suitable legal indemnity policy where the property has a title defect which the sellers refuse to rectify or in compliance with mortgage conditions for the mortgage lender.  Situations such as this arise periodically and are worth noting.
